Effective July 1, 2004, HB 2293 provides for a service of process fee to be paid to the sheriff.  After July 1, in chapter 60 and 61 actions, any writ, process, order or notice, that requires service, must be accompanied by a $5.00 process fee.  This fee must be separate from the filing fee and must be a check or money order made payable to the sheriff of the County where service is to be made.  The exception to that would be if service were to be made by the local sheriff to a box number in another County.   If the process fee is included in the filing fee, the case will not be filed, and will be returned to the attorney.  If a case is filed, but has no process fee attached, it will still be sent to the sheriff for process, but the sheriff will then contact the attorney for the process fee.
